Terms of Service

1. Who we are
Sessurely is operated by Silk Creative Labs LLC (“Sessurely,” “we,” “us”). These Terms govern your access to and use of the Sessurely website, app, and services (the “Service”). By creating an account or using the Service, you agree to these Terms.
2. The Service
Sessurely helps service professionals (“Providers”) take bookings, collect deposits, reduce no-shows, and manage clients. Providers configure their own services, prices, deposits, and policies. Sessurely provides the software; the Provider is responsible for the services they sell to their own clients.
3. Accounts
You must provide accurate information and keep your login secure. You are responsible for activity under your account. You must be at least 18 and able to form a binding contract.
4. Payments and subscriptions
Paid plans are billed in advance on a recurring basis (monthly or annually, depending on the plan you choose) through our payment processor (Stripe). Trials, if offered, convert to paid unless cancelled before the trial ends. You can cancel anytime; cancellation stops future charges but does not refund the current period unless required by law. Prices may change with notice; changes apply to the next billing cycle.
5. Deposits, no-show fees, and payouts
When a Provider enables deposits or card-on-file protection, their clients’ payments are processed via Stripe and routed to the Provider’s connected Stripe account. Sessurely may charge a no-show-protection fee (currently 2%, capped at $10) on the deposits and no-show/late-cancel fees we process. The Provider sets and is responsible for their own deposit, cancellation, and no-show policies and for charging clients in accordance with them and applicable law. Standard Stripe processing fees apply to charges.
Limits, payout timing, and holds. To manage risk on our platform, Sessurely sets, and may change, limits on Provider funds and the timing of Provider payouts. This includes a maximum deposit or no-show fee amount a Provider may set, which starts lower for new accounts and increases as an account builds a clean history; the timing of payouts to a Provider’s bank, which Sessurely controls and which is longer for newer accounts; and, where warranted, holds, reserves, or delays on some or all funds to cover potential refunds, disputes, chargebacks, or suspected fraud. We may withhold, delay, reserve, offset, or reverse payouts and recover negative balances to the extent needed to cover these amounts. These limits and timings vary by account and may change over time. A Provider may contact support@sessurely.com to request a higher limit or faster payouts, which we grant at our discretion.
6. Refunds and cancellations
Subscriptions. You can cancel at any time from your billing settings. Cancellation stops future charges and takes effect at the end of the current billing period; we don’t refund the unused part of a period unless required by law. If you subscribe through Apple, Apple bills you and handles refunds under its own policy; request those from Apple, not from us.
Client deposits and fees. If a Provider cancels, or a client cancels within the Provider’s cancellation window, a paid deposit is refunded in full and any card hold is released automatically. If a client cancels after that window or doesn’t show, the Provider’s policy applies: the deposit may be kept, or the no-show / late-cancel fee charged to the card on file. Providers who haven’t turned on no-show protection charge nothing. A deposit or fee that is later disputed, charged back, refunded, or found to result from fraud may be reversed or withheld, and the related funds recovered from the Provider, including from held or reserved balances.
Who to contact. Sessurely processes these payments on the Provider’s behalf. The Provider sets the policy and receives the funds. Clients with a question about a charge should contact the Provider first; if that doesn’t resolve it, email support@sessurely.com and we’ll help. Card disputes go through your card issuer and Stripe.
7. Acceptable use
Don’t use the Service to break the law, infringe others’ rights, send spam, attempt to disrupt or reverse-engineer the Service, or process payments for prohibited activities. We may suspend accounts that violate these Terms or that create risk for us or our processors.
8. Your content and data
You retain ownership of the content and client data you put into the Service. You grant us a limited license to host and process it to provide the Service. You are responsible for having the right to upload client information and for complying with privacy laws applicable to you. Our handling of personal data is described in our Privacy Policy.
9. Third-party services
The Service relies on third parties including Stripe (payments), Supabase (data hosting), and messaging providers for email/SMS. Your use may be subject to their terms. We are not responsible for third-party services.
10. Text messaging (SMS)
If a Provider enables SMS and a client provides a mobile number when booking, Sessurely may send that client transactional text messages about their appointment: reminders, booking confirmations, and no-show or late-cancellation fee notices. These are not marketing messages. Message frequency varies with appointment activity. Message and data rates may apply. Reply STOP to any message to opt out of texts, or HELP for help. Consent to receive texts is not a condition of any purchase. Mobile opt-in information is used only to send these appointment messages and is never shared or sold to third parties for their own marketing. Carriers are not liable for delayed or undelivered messages.
11. Disclaimers
The Service is provided “as is” without warranties of any kind to the maximum extent permitted by law. We do not guarantee the Service will be uninterrupted or error-free, or that it will prevent all no-shows or recover all funds.
12. Limitation of liability
To the maximum extent permitted by law, Sessurely and Silk Creative Labs LLC will not be liable for indirect, incidental, or consequential damages, and our total liability for any claim is limited to the amount you paid us in the 3 months before the claim.
13. Termination
You may stop using the Service at any time. We may suspend or terminate access for violation of these Terms or to comply with law. On termination, you may export your data for a reasonable period unless prohibited by law.
14. Changes
We may update these Terms; material changes will be posted here with a new date. Continued use after changes means you accept them.
15. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Courts located in California will have exclusive jurisdiction, except where applicable law provides otherwise.
